Welcome to Asheville Electrical Contractors (the "Site"). These Terms of Service ("Terms") govern your use of the Site and the lead generation services provided by the Site Operator, Innovation Digital Marketing ("IDM," "We," "Us," or "Our").

By accessing or using the Site or calling the phone number displayed on the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Site or our services.

1. Definitions

  • "Site": Refers to the website Asheville Electrical Contractors and any content or services offered through it.

  • "IDM" or "Site Operator": Refers to Innovation Digital Marketing, the company that owns, operates, and manages the Site and collects the leads.

  • "Local Service Provider": Refers to the independent, third-party service business(es) that contract with IDM to receive leads (e.g., the actual electrical contractor).

  • "Services": The core service provided by IDM, which is the collection of consumer contact and service request information (the "Lead") and the transmission of that Lead to one or more Local Service Providers.

2. Nature of Service and Disclaimer

IDM is a Lead Generation Service, not a Service Provider.

A. No Contract for Services: You understand and agree that Innovation Digital Marketing is not an electrical contractor, is not the Local Service Provider, and does not perform or contract for any services requested via this Site. The Services we provide are limited solely to the generation and delivery of leads.

B. Independent Contractors: Any Local Service Provider contacted through the Services is an independent contractor and not an agent, employee, or representative of IDM. IDM does not endorse, guarantee, or warrant the work, professional ability, license, or insurance of any Local Service Provider.

C. Liability Disclaimer: IDM is not responsible for any disputes, damages, delays, or losses arising from the services, lack of services, conduct, or performance of the Local Service Providers. Your recourse for issues related to service quality, billing, or contract performance is solely against the specific Local Service Provider.

D. User Responsibility: You are solely responsible for investigating and vetting the Local Service Provider, including verifying their licensing, insurance, and reputation, before entering into any contract for services.

3. Lead Submission and Communication Consent

A. Voluntary Submission: By filling out a contact form or calling the phone number displayed on the Site, you are voluntarily requesting that IDM collect your personal and service request information and share it with Local Service Providers.

B. Consent to Contact: You expressly consent to be contacted by Innovation Digital Marketing and the one or more Local Service Providers by phone (including automated or pre-recorded calls, to the extent permitted by law), text message (SMS), or email at the contact information you provide, even if your phone number is on a state or federal Do Not Call list. This contact is necessary to fulfill your service request.

C. No Guarantee of Service: IDM makes no guarantee that a Local Service Provider will contact you, offer you a service, or that any contact will result in a successful quote or completed service.

4. Intellectual Property Rights

A. Site Ownership: The content, organization, design, compilation, and other matters related to the Site (excluding user-provided content and third-party links) are protected under applicable copyrights, trademarks, and other proprietary rights and are the property of Innovation Digital Marketing.

B. Limited License: You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms for your personal, non-commercial use to seek a local service provider.

C. Restrictions: You agree not to copy, reproduce, modify, publish, display, distribute, sell, or exploit any portion of the Site for any commercial purpose without the express written permission of IDM.

5. Website Usage Rules

You agree not to use the Site to:

  • Violate any applicable local, state, national, or international law.

  • Transmit or post any material that is libelous, defamatory, offensive, or otherwise objectionable.

  • Engage in any activity that interferes with or disrupts the operation of the Site or the servers or networks connected to the Site.

  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.

  • Use automated means, including spiders, robots, crawlers, or data mining tools, to download data from the Site.

6. Disclaimers of Warranties

The Site and the Services are provided on an "as-is" and "as-available" basis. INNOVATION DIGITAL MARKETING EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IDM MAKES NO WARRANTY THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

7. Limitation of Liability

Under no circumstances shall Innovation Digital Marketing be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including damages for loss of profits, goodwill, use, or data) resulting from:

  1. The use or the inability to use the Site or the Services.

  2. The cost of procurement of substitute goods and services.

  3. Any services provided by any Local Service Provider.

  4. Unauthorized access to or alteration of your transmissions or data.

8. Indemnification

You agree to indemnify, defend, and hold harmless Innovation Digital Marketing, its officers, directors, employees, agents, and affiliates, from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Services, your violation of these Terms, or your interactions with any Local Service Provider.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Haywood County, North Carolina. You hereby consent to the personal jurisdiction of such courts.

10. Changes to Terms

IDM reserves the right to change, modify, or revise these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Site, with the "Last Updated" date at the top of the Terms being adjusted. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.
